These Terms & Conditions apply to all purchases made through Good Bear.

2. Applicability

These Terms & Conditions apply to all offers, orders, purchases, deliveries, catering services, corporate orders, and other agreements entered into with Good Bear B.V.

By placing an order, the customer agrees to these Terms & Conditions.


3. Products

Good Bear produces freshly baked cookies prepared specifically for each order.

Product photographs are intended for illustrative purposes only. Minor variations in appearance, colour, texture, size, or decoration may occur and do not constitute a defect.

Due to transportation conditions, ambient temperature, handling, and storage conditions, the appearance, texture, and freshness of products may vary. Such variations do not constitute grounds for compensation, refund, replacement, or cancellation.


4. Pricing

All prices displayed on the website are in Euros (€) and include applicable VAT unless otherwise stated.

Good Bear reserves the right to modify prices at any time. The price applicable to an order is the price displayed at the time the order is placed.

In the event of obvious pricing errors, technical errors, or system malfunctions, Good Bear reserves the right to cancel the order and refund any amount already paid.


5. Orders

Orders are subject to acceptance by Good Bear.

Good Bear reserves the right to refuse, limit, or cancel any order at its sole discretion, including but not limited to cases involving suspected fraud, payment issues, technical errors, product unavailability, pricing inaccuracies, force majeure events, or any circumstance that prevents Good Bear from fulfilling the order as intended.

In such cases, any payment already received will be refunded in full.

Once an order has been placed, it cannot be modified.

As an exception, Good Bear may, at its sole discretion, accept modification requests received on the same working day the order was placed.

No modification request is guaranteed.


6. Freshly Baked Products, Cancellations and Right of Withdrawal

All cookies are baked fresh specifically for each customer order.

Orders are incorporated into Good Bear’s production planning and internal scheduling to ensure maximum freshness and quality.

Due to the perishable nature of our products and the fact that they are baked specifically to order, cancellations and refunds are generally not possible once an order has been accepted by Good Bear.

Exceptions may be made where Good Bear has made an error with the order or where required by applicable law.

Orders for freshly baked cookies are exempt from the statutory right of withdrawal under applicable Dutch and European consumer legislation due to their perishable nature and because they are produced specifically upon customer request.


7. Shipping and Delivery

Orders are shipped within the Netherlands using DPD.

Customers select a shipping date during checkout.

The selected date represents the date on which the order is shipped, not the date on which the order will be delivered.

Delivery services are performed by DPD and remain outside the direct control of Good Bear.

While delivery delays are uncommon, they may occasionally occur.

Good Bear cannot guarantee delivery on a specific date and shall not be liable for delays caused by DPD or other circumstances beyond its reasonable control.

Customers are responsible for providing complete and accurate delivery information at the time of purchase.

Good Bear shall not be liable for delays, failed deliveries, lost shipments, additional shipping charges, or any other consequences resulting from incorrect, incomplete, or outdated address information supplied by the customer.


8. Damaged Shipments

Customers must inspect their order upon receipt.

If a product arrives damaged, customers should contact Good Bear as soon as reasonably possible and provide photographs of both the packaging and the products.

Claims are reviewed on a case-by-case basis.

Submission of a claim does not automatically entitle the customer to a refund, replacement, compensation, or store credit.

Good Bear reserves sole discretion in determining the appropriate resolution.


9. Refused, Returned or Uncollected Shipments

If a shipment is refused by the recipient, returned due to an incorrect address, or remains uncollected from a pickup point, Good Bear shall not be obligated to issue a refund, replacement, or store credit.

Due to the perishable nature of the products, returned orders cannot be resold, reused, or re-shipped.


10. Allergens and Food Safety

Products may contain or come into contact with:

  • Gluten

  • Milk

  • Eggs

  • Soy

  • Peanuts

  • Tree nuts

All products are prepared in the same kitchen environment.

Cross-contamination cannot be excluded.

For this reason, Good Bear products are not suitable for individuals with severe allergies.

Customers are responsible for reviewing product information and determining whether a product is suitable for their personal dietary requirements before placing an order.


11. Corporate Orders, Catering and Events

Corporate gifting, catering, and event orders may require full prepayment and/or a deposit before production begins.

Cancellation conditions for catering, corporate, and event orders are as follows:

  • More than 10 working days before the agreed delivery date: full refund.

  • Between 5 and 10 working days before the agreed delivery date: 50% refund.

  • Less than 5 working days before the agreed delivery date: no refund.

Working days are Monday through Friday and exclude Dutch public holidays.

Good Bear may begin purchasing ingredients, allocating production capacity, and scheduling staff immediately upon confirmation of the order.


12. Gift Cards

Physical gift cards may be purchased exclusively in-store.

Gift cards are non-refundable and cannot be exchanged for cash.

Gift cards do not expire unless otherwise required by applicable law.

Lost, stolen, damaged, or unauthorizedly used gift cards may not be replaced or reimbursed.


13. Customer Accounts

Customers may create an account on the website.

Customers are responsible for maintaining the confidentiality of their account credentials and for all activity occurring under their account.

Good Bear reserves the right to suspend, restrict, or terminate accounts in cases of abuse, fraud, unlawful activity, or violation of these Terms & Conditions.


14. Intellectual Property

All content displayed on the websites, including but not limited to:

  • Logos

  • Trademarks

  • Product names

  • Photographs

  • Graphics

  • Website design

  • Text content

is the exclusive property of Good Bear B.V. or its licensors.

No content may be copied, reproduced, distributed, modified, published, displayed, transmitted, or commercially exploited without prior written consent from Good Bear.


15. Limitation of Liability

To the maximum extent permitted by law, Good Bear shall not be liable for:

  • Indirect damages;

  • Consequential damages;

  • Loss of profits;

  • Loss of business opportunities;

  • Delivery delays caused by third parties;

  • Temporary website interruptions;

  • Circumstances beyond its reasonable control.

Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited under Dutch law.


16. Privacy

Personal information is processed in accordance with Good Bear’s Privacy Policy.

By placing an order, customers consent to the processing of their personal information as necessary to fulfil the order, provide customer service, process payments, arrange shipping, and comply with legal obligations.


17. Governing Law and Disputes

These Terms & Conditions are governed exclusively by Dutch law.

Any disputes arising from these Terms & Conditions or agreements with Good Bear shall be submitted to the competent courts of the Netherlands unless mandatory consumer protection laws provide otherwise.
